Terms & Conditions of Warranty

All warranty claims must be filed by the immediate or original purchasers from Roto Moulding Sdn Bhd. (herein after referred to as “Roto” and the definition “Roto” is inclusive of any company of the Roto Group of companies) through Roto.
Subject to Clause 5 herein , regardless of when payment is made, the warranty period shall commence to run from the Commissioning date for the product(s) (“product unit”) that are installed or the date of this Warranty Certificate whichever is relevant according to Roto PROVIDED ALWAYS that Roto’s liability will only commence upon full and final payment of the purchase price.
Roto is not obliged to honour the warranty herein and / or to replace the Warranty Certificate in the event that :-
- such Warranty Certificate is misplaced / loss / stolen ; and / or
- the product unit is transferred to or possessed by other users and no longer owned by
  the immediate / original purchaser as specified in the Warranty Certificate.
Subject to the terms and conditions set out in this Warranty Certificate, Roto warrants a limited warranty that guarantees the product(s) to be free from defects in material and factory workmanship under proper and / or normal operating conditions for a period stipulated on the Warranty Certificate.
This warranty is only limited to the cost of providing repair/make good or the replacement of a defective product unit during the warranty period and does not cover any labour cost ,service charge and / or any incidental or indirect expenses incurred arising from the repairing or replacement of the defective product unit.
Under the following circumstances, cost of repair / replacement will be chargeable even during the warranty period if :-
- Warranty Certificate / sales invoice cannot be produced when a claim is made ;
- Claim is not made by the original / immediate purchaser(s) of Roto ;
- The Warranty Certificate is altered or tampered with ;
- The causes of failure are found not due to inherent defects in material and factory workmanship;
- Use of the product unit other than for its normal intended use ;
- Failure to install the product unit in accordance with the installation manual / standard code of practices / ordinance / regulations in Malaysia ;
- Failure resulting from abuse ,tampering ,faulty care, improper maintenance and / or damaged while during site handling while lifting / unloading ;
- Damage is due to the failure or inadequate civil ,structural, building works and / or natural disasters ;]
- The defective product unit has been repaired ,modified or dismantled by technicians not authorized by Roto and ;
- The defective product unit was a result caused by force majeure.
Warranty for components / parts / accessories not manufactured by Roto but is incorporated as part of the product unit is limited to the warranty extended to Roto by the suppliers, which the terms and conditions are hereby attached or deemed attached.
This warranty is strictly limited to the replacement of the defective part or the whole product unit sold only .However, Roto reserves its rights to repair or replace the defective product unit.
Roto shall not be liable to the purchaser by reason of any representation ,or any implied warranty ,condition or other terms ,or any duty at common law ,for any penalties ,incidental ,consequential loss or damage ( whether for loss of profit or otherwise ) ,costs , expenses or other claim for consequential compensation or whatsoever .
This warranty given by Roto shall be effective and enforceable by the purchaser only upon receipt of full payment for the product(s) purchased in accordance with the sales contract / invoice / letter of acceptance covering the product(s) to which the Standard Conditions of sale and this warranty also apply .Until after such payment is received in full without any deductions whatsoever ( unless agreed by Roto ) .Roto shall in the meantime be relieved of any / all obligations to honour this warranty .
The purchaser is required to notify Roto or its authorised sales office of the failure of the product(s) and produce the warranty Certificate within fourteen (14) days from the date of a reason for a claim becoming known by the purchaser. Roto reserves the right to inspect on site of alleged defects before Roto can be required to honour any warranty claim.
Repair to the product(s) must be carried out by Roto or any other person authorised by Roto .Any alteration or repair done by the buyer without Roto’s written consent will render the warranty void.
This warranty shall not apply to :-
- products not purchased or sourced directly from Roto or its authorised dealers in Malaysia; and / or
- products not purchased ,installed ,used or operated in Malaysia.
Roto’s liability with respect to its product(s) is expressly limited to the remedies set forth above. The remedies are the purchaser’s exclusive remedies.
Roto makes no warranty other than stated in this Warranty Certificate and hereby disclaims all other warranties, expressed or implied, including but not limited to any implied warranties, of merchantability or fitness for a particular usage and any implied or express warranty.
In the event that there is any dispute as to the interpretation of, or concerning any condition and terms or any matter arising from this Warranty Certificate, the parties shall refer such dispute to a single arbitrator.
Roto reserves the right to impose additional charges or may refuse to attend to any products installed locations which are inaccessible and / or hazardous to its service agents.
No person, by dealer / company is authorized to change, modify or extend the terms of these warranties in any manner.
Roto reserves the right to change this terms and conditions without any prior notice.

Warranty Policy – Products and Warranty Period

Open Top Series – 10 years indoor use or 8 years outdoor use
Closed Top Series (Black) – 10 years indoor use or 8 years outdoor use
Closed Top Series (Colour) – 20 years indoor use or 15 years outdoor use (warranty for colour fading)
Premium Stone Effect Tank – 20 years indoor use or 15 years outdoor use (warranty for colour fading)
Septic Tank – 5 years
